Terms of Service

These Terms of Service ("Terms") govern access to and use of Kunjey, the property management platform, websites, and related applications (collectively, the "Service") provided by Kunjey ("Kunjey", "we", "us", or "our"). By creating an account, accessing, or using the Service, you ("you", "User", or "Customer") agree to be bound by these Terms. If you are using the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

If you do not agree to these Terms, you must not access or use the Service.

1. The Service

Kunjey provides a property management system for vacation rental owners, property managers, and hospitality operators, including but not limited to: multi-property calendar and booking management, a channel manager that synchronizes availability, rates, and reservations with third-party booking channels (such as Airbnb, Booking.com, Expedia, and other online travel agencies), guest and reservation management, unified guest messaging, task and cleaner scheduling, payment and invoicing tools, reporting and analytics, and related features we may introduce from time to time.

We may add, modify, or discontinue features of the Service at our discretion, and we will make reasonable efforts to notify you of material changes that affect your use of the Service.

2. Accounts

You must register for an account to use most features of the Service. You agree to provide accurate, current, and complete information during registration and to keep this information up to date. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@kunjey.com if you suspect any unauthorized use of your account.

You must be at least 18 years old, and legally capable of entering into a binding contract, to create an account.

3. Subscription Plans, Billing, and Cancellation

Access to certain features requires a paid subscription. Subscription fees, billing cycles, and included features are described on our pricing page or in an order form agreed with you. Unless otherwise stated, fees are billed in advance on a recurring basis and are exclusive of applicable taxes, which you are responsible for paying.

• Free trials, where offered, convert to a paid subscription unless cancelled before the trial ends.
• You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period.
• Except where required by law or expressly stated otherwise, fees already paid are non-refundable.
• We may change subscription pricing with reasonable prior notice; changes apply from your next renewal.

4. Your Content and Data

"Customer Data" means the property listings, rates, availability, reservations, guest information, messages, documents, and other content and data you or your guests submit to or generate through the Service, including data received from connected booking channels. You retain all ownership rights in your Customer Data. You grant Kunjey a limited, non-exclusive license to host, process, transmit, and display Customer Data solely to provide, maintain, and improve the Service, including synchronizing it with the third-party channels you connect.

You are responsible for the accuracy and legality of the Customer Data you upload, including having the necessary rights and consents to share guest information with Kunjey and with any third-party channels you choose to connect.

5. Third-Party Channels and Integrations

The Service allows you to connect third-party booking channels, payment processors, messaging providers, and other integrations. Your use of those third-party services is governed by their own terms and policies, and Kunjey is not responsible for their acts, omissions, availability, or accuracy of data they provide. Where a channel enforces its own rate limits, sync frequency, or content rules, we apply those constraints to keep your account in good standing with that channel.

6. Payments

Where the Service facilitates guest payments, deposits, or payouts, such payments are processed by third-party payment processors. Kunjey does not store full payment card numbers and is not a party to the underlying payment transaction between you and your guest beyond providing the technical means to process it. You are responsible for complying with applicable payment card industry, consumer protection, and tax obligations related to amounts you collect from guests.

7. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law, regulation, or the terms of any connected booking channel;
• Upload content that is unlawful, fraudulent, defamatory, or infringes the rights of others;
• Attempt to gain unauthorized access to the Service, other accounts, or our infrastructure;
• Introduce malware, or interfere with or disrupt the integrity or performance of the Service;
• Scrape, reverse engineer, or resell the Service without our prior written consent;
• Use the Service to send unsolicited communications to guests or third parties.

8. Intellectual Property

The Service, including its software, design, trademarks, and documentation, is owned by Kunjey and its licensors and is protected by intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are granted to you in our intellectual property.

9. Confidentiality

Each party may have access to non-public information of the other party. Each party agrees to use the other party's confidential information only to perform its obligations under these Terms and to protect it with the same degree of care it uses to protect its own confidential information, but no less than a reasonable degree of care.

10. Service Availability

We work to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable for maintenance, updates, or reasons outside our reasonable control, including outages or changes on third-party channels we integrate with.

11. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you materially breach these Terms, fail to pay applicable fees, or if we reasonably believe your use of the Service creates risk or legal exposure for Kunjey or others. Upon termination, your right to use the Service ceases, and we will handle any retained Customer Data in accordance with our Privacy Policy.

12. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, express or implied. Kunjey will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to your use of the Service, even if advised of the possibility of such damages. Our aggregate liability for any claim arising out of these Terms will not exceed the amount you paid to Kunjey for the Service in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify and hold Kunjey harmless from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your Customer Data, or your violation of these Terms or applicable law.

14. Governing Law

These Terms are governed by the laws of the United Arab Emirates, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms will be subject to the exclusive jurisdiction of the competent courts of the United Arab Emirates, unless otherwise required by applicable law.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice, such as by posting the updated Terms on this page with a new effective date or by other reasonable means. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
